			<content:encoded><![CDATA[<p>The K-1 visa allows foreign nationals engaged to American citizens to come to the United States for the purpose of performing the marriage. According to the rules governing the K-1 fiance visa, the couple has a 90 day window in which to marry. If the marriage is not completed within this period, the K-1 fiance visa expires, and the visitor must return to his or her native country. The 90 day period cannot be extended. If the couple does marry within the 90 day window, the K-1 visa holder can then file form I-485 Application to Register Permanent Residence or to Adjust Status with the USCIS in order to become a permanent resident of the United States.</p>
<p><strong>K-1 Fiance Visa</strong><strong></strong><br />
The K-1 fiancee visa application requires filing form I-129 with the USCIS. After the USCIS has approved the visa, the petitioner then has 4 months to utilize the visa and come to the United States, although that period can potentially be extended by consular officers. After coming to the United States on the K-1 visa, the visa holder cannot leave the U.S. and return on the same visa. He or she would be required to apply for an entirely new K-1 visa in order to return.</p>
<p>A fiance(e) is someone engaged or contracted to be married, and it is generally required that the couple have met in person within the last two years, although there can be exceptions to this rule.</p>

			<content:encoded><![CDATA[<p style="text-align: justify;">The H3 visa is a nonimmigrant visa which gives those seeking the opportunity to come to the United States to train in various disciplines the ability to do so.  The training must serve the purpose of advancing the foreign national&#8217;s career somewhere other than in the United States, and must be a form of training unavailable in his home country.  The training can cover virtually any field aside from medical training or graduate education.  These include agriculture, finance, technology and government.</p>
<h3><strong>H3 Trainee Visa:</strong></h3>
<p style="text-align: justify;">The H3 visa permits holders of the visa to stay in the United States for a maximum of 2 years.  The visa cannot be extended, and in order to reapply, the applicant must spend at least six months outside of the United States.  The H3 visa permits bringing a spouse and any unmarried children under age 21 under H4 status, which does not permit them to work within the United States.  The H3 visa allows the holder of the visa to travel both within the United States and outside of the country.</p>
<p style="text-align: justify;">Applicants for the H3 visa must be prepared to demonstrate the need for the training, the lack of availability of equivalent training in their home country, and how the training will assist in their career pursuits outside of the United States.</p>

The R-1 visa is a non-immigrant visa that enables religious workers to come to the United States to work in that capacity for a limited period of time. To qualify as a religious worker, one must either be authorized by his employer to perform duties generally performed by the religion&#8217;s clergy or be a worker at a religious occupation. These occupations can include nuns and priests as well as religious instructors and missionaries. Eligibility for the R-1 visa also requires membership in the religious denomination the applicant is employed by for at least the two years immediately preceding application for the R-1 visa. Additionally, the denomination itself must have a bona fide nonprofit religious organization in the United States.</p>

<p style="text-align: justify;"><strong>R1 Visa Attorney</strong></p>
<p style="text-align: justify;">The R-1 visa permits residence in the United States for a period of three years. This period can be extended for a maximum of two years, after which the visa expires and the holder of the visa must return to his or her native country.  R-1 visa holders are permitted to change employers during their stay, but must file a new form I-129 in order to do so.
